classes as part of a modernized North American trade deal.
iPolitics has learned that the 11th hour deal reached Sunday night between
Canada and the United States eliminates the controversial Class 7 which is a
domestic pricing class that governs milk ingredients such as skim milk
powder and milk proteins.
Under the agreement, now called the United States-Mexico-Canada Agreement (
USMCA), three products formerly included within Class 7 will be priced at
the U.S. price. Those three products, iPolitics has been told, are: milk
protein concentrate, skim milk powder and infant formula.
Class 7 used the world price as a reference – a move American producers
argued undercut them from the Canadian market. All other goods listed under
Class 7 will be priced according to their end use, the sources said.
It is unclear whether the goods listed under Class 7 will be rolled into
another milk class or whether new class will be created to capture them.
Also unclear is whether the provinces will agree to the concession. Under
Canadian law, responsibility for agriculture is shared between the provinces
and the federal government.
Milk pricing is considered a provincial responsibility.
Under the new trade agreement, Canada has also offered up access to its
dairy, poultry and egg markets, sources say.
The access, iPolitics has been told, is similar to what the Canadian
government agreed to under the Comprehensive and Progressive Trans Pacific
Partnership.
Under the new United States-Mexico–Canada Agreement, American dairy
producers will have access to 3.5 per cent of Canada’s dairy market –
slightly higher than what was agreed to under the CPTPP, which was 3.25 per
cent.
Figures for eggs and poultry have not yet been made public, but are believed
to be in the same realm as what was allocated under the CPTPP.
Federal officials said Sunday night that compensation is expected for

As part of the new deal, Canada will offer the U.S. greater access to its
diary market than what the U.S. would have achieved through the Trans-
Pacific Partnership, a trade treaty that Trump withdrew from last year, the
senior administration official said.
A dispute resolution process that the U.S. had wanted to scrap but Canada
wanted to keep will be revised, the official said, and the new accord will
include an “accommodation” to help shield Canada if Trump follows through
on a threat to tax imported vehicles.
It was not immediately clear what that accommodation would entail, but
published reports suggested Canada could be exempt from the auto tariffs if
it agrees to limit its auto exports to the U.S.
Other new provisions are changes to the so-called auto rules of origin which
dictate that, to avoid tariffs, a certain percentage of an automobile must
be built from parts that originated from countries within the NAFTA region.
Under the new rules, cars must be built with at least 75 percent of parts
made in North America, up from 62.5 percent under NAFTA. Also, 40 to 45
percent of an auto will have to be made by workers earning at least $16 an
hour.
The new trade deal also includes standards designed to protect intellectual
property and trade secrets, tougher labor requirements for Mexico and
environmental obligations designed to combat trafficking in wildlife, timber
and fish.
The agreement will run for 16 years, but will be reviewed after six years
