发帖数: 395 | 8 你这就搞笑了，美国的司法系统是怎么运作的？要是什么都能用“老实”，“坑蒙”来
定义的话，那还要律师做什么？在美国，只要你在法律的规定下说理说的通，就要大胆
的维护自己的利益。
建议楼主去咨询一个懂交通法的律师，如果是随便咨询一下，应该不会收费的。

did Trail by Declaration by myself. You do not admit and do not deny the
driver is you. If you deny, you are lying which can put youself into trouble
. If you admit then you lost the case. FYI. Here is part of statement I
wrote on the form. " If a picture will be used as court evidence, at least
it should show clear face characteristics, such as eyes, noce, etc. This
picture fails to demonstrate that.So I request your honot to consider that
this picture should not be used as court evidence ........". Within one
month, I received the court decision for the case "dismiss" and I just
received the refund of $500 check for the bailed amount.I never thought it
was that easy.
Of course, I did more things, including took photo and video at the
intersection. etc. I spent a quite lot of time doing the reserch. You should
research on the internet. |

你可以选择上庭争取免点免罚款 逃脱责任只会罪加一等

发帖数: 1153 | 15 没那么简单 我觉得一般都是假定registered owner就是driver，这个取决于设立
camera的county或者city。当然在法庭上你是可以尝试argue证据不足，法官也许会
dismiss这个case。但是你自己要承担风险，也有可能法官不买你的帐。
比如seattle的规定是：
Q. WHAT IF THE REGISTERED OWNER WAS NOT DRIVING THE VEHICLE AT THE TIME OF
THEVIOLATION?
A. You may submit a sworn statement to that effect to the Court to rebut the
presumption,established in RCW 46.63.075, that you were driving the vehicle
at the time of theviolation. A Declaration of Non-Responsibility form can
be obtained from the Court in any of the following ways:

use camera for citation. Only Union city stop using camera recently.Other
