记得有人这么做过,就在版上看到的。有几个问题想请教。
1. 如果我是唯一买家,可以和卖方经纪协商,将省下的佣金从房价里减掉吗?
2. 还是用CAR的标准合同吗?哪里能下载这个表?

可以协商
CAR form是有版权的.我们agent每年要付fee才有权使用. 不知道有没有按次使用的付
费方式. 您可以到car.org上看一下.

1.佣金应该不会从房价里减掉,除非SELLER和LISTING AGENT重新签LISTING AGREEMENT,
把合同里的佣金数目降下来.理论上可以,但我从来没见到过.房子上市前, SELLER和
LISTING AGENT之间就签署了合同,规定了LISTING AGENT卖房的佣金.如果有BUYER
AGENT, LISTING AGENT会50/50来分给BUYER AGENT. 注意:是LISTING AGENT付钱给
BUYER AGENT(不是SELLER),原因是BUYER AGENT帮LISTING AGENT找到了READY,WILL,
QUALIFY的BUYER.当然这钱最终是BUYER的买房钱.如果BUYER没有AGENT, 那就是LISTING
AGENT自己找的BUYER,自己拿全部佣金. 当然你可以同LISTING
AGENT谈判REBATE.
2.到LOCAL的房地产协会可以买到单独的表格.
看样子,你的房地产只是还很有限,建议你找个给REBATE的AGENT吧.

What if I am an agent and buy a home for myself? Can I still split the
commission? Will the builder commission for the new home also be issued to
me?
I hear that the typical 2.5% buyer commission needs to give the broker 0.25%
or 0.5%, then 50/50 split between agent and buyer. So 1%~1.1% rebate is
resonable, isn't it?

建议您就找个agent, 返您1.25%. 除非您以后要做地产这一行, 只为买一个房子, 真没
必要拿个license,要挂靠broker, 还要加入board,每年要付费用. CAR 看别人写很简单
, 但是如果不了解每一项的意思, 写错一个, 可能官司就来了.

1. 我是AGENT,我自己买房一样要和我的BROKER来SPLIT.当然我的佣金一部分会以
REBATE的方式(不交INCOME TAX),留一部分作为我AGENT的收入.
关于新房,AGENT不是合同中的一方,拿的钱叫REFERRAL FEE,不是COMMISSION. 新房更应
该找一个给REBATE的AGENT. 因为BUILDER的价格是一样的,省下的REFERRAL FEE是
BUILDER的纯利润.所以BUILDER对买家登记管的越来越严. AGENT必须和客户一起去登记
才能拿到钱.如果是DUBLIN/SAN RAMON的新房,可以联系我.我对那里新房很熟.
2.你说的20% BROKER的SPLIT, 应该算是有经验的AGENT. BROKER对新手的剥削很重,所
以新手前2年的淘汰率很高.10%的SPLIT是非常有经验的AGENT或是PARTNER.基本自己也
是BROKER. 关于1-1.25%的REBATE,关键看AGENT的个人以及房子的价格. 价格越高,
REBATE越高. 要是30W的房子,估计有REBATE就不错了. 新房的REBATE要高些,主要买新
房的过程中AGENT的工作量要少很多.

1, 既然有卖方经济,那么他自动是你的经济,if you don't have,怎么做是你们之间
协商。
2. seller agent should have that form. Seller agent is your agent.

New home builder usually gives fixed amount of referral fee to buyer agent.
In most cases ,it is less than 2.5% of sales price.

Really? The seller agent actually asks me to write an offer myself. Is there
an official link to describe this special situation: buyer has no agent
while seller has one.
Online search also suggests me to find a real estate attorney to write an
offer, who only charges a flat fee. It doesn't mention anything about "
seller agent is also buyer agent by default, unless buyer has one".

It is true in CA. I don't know whether it is the same in other states.
I cannot send you attachment in MITBBS. There are only 2 parties in listing
agreement: Seller and listing agent ( broker). In the listing agreement,
seller agree to pay listing broker __% commission to sell this home. This
commission is the total amount for both listing agent and buyer agent. Buyer
Agent don't have any relationship with seller. In fact, buyer agent works
for listing agent to find a qualified buyer.
If you don't have buyer agent, listing agent is a dual agent by default. he/
she should prepare the offer for you. This listing agent didn't tell you
this and it is an unethical practice.
