CBP to Eliminate I-94 Card, Transition to Automated Arrival System

U.S. Customs and Border Protection has reportedly accelerated a plan to stop
issuing the paper Form I-94 arrival-departure card to nonimmigrants
entering the United States and replace the card with an automated arrival
database. The transition to the automated system could occur at U.S. ports
of entry in the very near future.
The elimination of Form I-94 will have an impact on many immigration
requirements and procedures. It is likely to change the way employers verify
work eligibility on Form I-9 and in the E-Verify system. It could also
delay the issuance of benefits that are dependent on I-94 data, including
Social Security numbers and driver’s licenses.
The Automated Arrival System
Form I-94 is presently issued to most foreign nationals entering the United
States on a nonimmigrant visa. The I-94 card governs the foreign national’s
period of authorized stay and contains his or her nonimmigrant status, the
expiration date of the stay, and a unique identifying number.
In the near future, CBP is expected to stop issuing I-94s to most
nonimmigrants and instead use an automated entry system to record each
nonimmigrant’s arrival. Travelers will receive a passport stamp annotated
with their immigration status and the date their period of stay expires.
There are indications that CBP may issue “nonfunctional” I-94 cards to
some, though the cards would not be connected to any federal database.
Foreign nationals entering at land ports of entry will continue to receive a
functional I-94, as will refugees and some other classes of foreign
nationals.
After the I-94 is eliminated, CBP reportedly may create an online portal to
allow nonimmigrants to check their status and period of stay and print out a
record of their admission.
What the Elimination of Form I-94 Means to Employers and Foreign Nationals
Under current rules, the I-94 is used as proof of lawful immigration status
in many contexts. Along with a valid foreign passport, the I-94 is one of
the documents used to verify a foreign national’s employment eligibility on
Form I-9 and in the E-Verify database. Numerous federal and state agencies
use the I-94 to verify whether a foreign national is entitled to certain
benefits, including a Social Security number and a driver’s license, among
others. USCIS rules require nonimmigrants to carry the I-94 as proof of
their status.
It is not yet clear how elimination of the I-94 will affect these critical
procedures and requirements. Though CBP has for some time been meeting with
interested government agencies about its automation program, specific plans
to revise regulations that currently require Form I-94 are not yet known.
Interim Delays Affecting Social Security and Driver’s License Applications
As CBP works on transitioning to the new automated arrival database, it has
announced lags of four to six weeks in entering I-94 data into government
systems. This is causing many foreign nationals to experience delays of
several weeks or more in receiving Social Security numbers and driver’s
licenses.
Under current procedures, a foreign national’s I-94 information is manually
entered into federal government databases after he or she enters the United
States. When the foreign national applies for a Social Security number or
driver’s license, the relevant government agency checks the federal I-94
database to verify the individual’s immigration status and eligibility for
the benefit. If an applicant’s I-94 data has not yet been entered into the
federal database, his or her status cannot be verified and the benefit
application cannot be immediately approved. The application will remain
pending until the I-94 data appears in the federal database and the
applicant’s status can be verified.
