假设你的application仅有一个claim，是这么写的：A device comprising A，B，C，
and D。
攻略分支一：examiner发现一个prior art。重点是：A'BC在prior art的
specification里面出现了，但是prior art的claim里面并没有A'BC, 只有D。（<--看
我看我！这句是重点！！）这个时候，examiner是102rejection的。这个时候他看不看
有没有common ownership其实没有关系。因为有没有common ownership，他发的都是
102rejection。而applicant拿到102 rejection以后，有common ownership的，就提交
132 declaration证明给examiner说我们有common ownership。
攻略分支二：examiner发现一个prior art。重点是：A'BCD都在这个prior art的claim

给你一个例子
我3月底把旧车卖了，因为买车的人需要修muffler，通过inspction才能register。我
就同意他先用我几天我的车牌。2周后他email说周末就归还我的plate，然后就没信了
。现在都2个月了，我给他写信，也不回复我。前不久收到了4月份闯红灯的ticket，
75
块。我现在也联系不上这个买车的。今天给DMV打电话，才得知我title还在我名字下面
，他根本没转title。
我现在应该怎么办？我今天已经cancel我的plate了，但是以前的罚单，只能我来付吗
？不付的后果怎么样？或者我可以提供他３月就买走我车的证据，这样我就不负责罚单
了？很烦心，当时好心结果他用，结果却惹了麻烦。当初卖车也没留一个title
transfer 复印件,都是教训。以后大家卖车，别像我似的。
如果你要在加州还要确认你的车可以过smog check，不然买方即便想过户也过不了。
还有一些仁兄也是建议说
-如果可能，或者最好和买家一起DMV transfer。
很重要的是收现金，一起去银行，直接让买家存进你的银行账户。感觉最近其他方式都

同意，那么应该人人配枪了？这绝对是体制问题，美国这种案例层出不穷，坚持这个
amendment就是不惜以小孩的生命，还有将来不知谁的生命为代价。话说为什么街上从
不见人带枪呢？

你搞清谁是owner后，只要看一个instruction就够了。
Generally if US person owns <=50% CFC, US person 不control CFC，自愿 file
Form5471 如果没有ownership change. 你所说的>10% ownership是指US ownership
change. 比如US person只own 11%，是第一年，你要file 5471, Sch.O，以后几年没有
ownership变化，不许要file 5471,但有一些很特初的列外。最后一年dispose CFC时也
要file 5471+Sch. O.
还有ownership不光是direct，还有indirect，你要用Sec.318 attribution test. |

102 rejection，是prior art anticipate each and every element in your claim.
但是这些anticipation，可能在specification里面，可能在claim里面。
例如，你的claim里面是ABCD。
Prior art里面有A'BCD，但是A'BC三个element都在prior art的specification里面的
，只有D在prior art的claim里面才有的。
这个就是102
rejection，而不能是double patenting。这个时候common ownership是帮助你摆平102
rejection的。
但是假设你的claim里面是ABCD，
prior art里面也有A'BCD。可是Prior art里面的A'BCD全在它的claim里面，
这个时候examiner会看有没有common ownership，有common ownership的话，会给你
