s********t 发帖数: 4150 | 1 I was denied tenure as well; the process was totally unfair. I went through
the courtesy year, and the appeal process. I feel every bit of your pain and
anxiety. Just a couple of words to share:
- There is no such thing as "a clean record". People can count the number of
AP years on your CV. Use the extra year to regroup and look for new jobs.
- Tenure denial is not the end of the world. If you are a good scholar, you'
ll be tenured elsewhere. School A's loss is School B's gain. There is
nothing wrong with moving outside academia, either.
- The appeal process, the way I understand and the way I experienced, is
almost strictly "procedural". The focus is procedural errors, and allows
almost no room for substantive arguments. Thus if you can't present a "
smoking gun" (e.g., racial discrimination), you chance of winning against
the administration only exists in theory. It is a painful, frustrating, and
lengthy fight with a dark prospect.
- It doesn't mean, though, the appeal is totally pointless. It may be a way
for you to regain sleep and to feel the sense of control. At the end of the
process, you can tell yourself, "I've done everything, and I don't regret
for the rest of my life." This may mean nothing, or a whole lot. Totally up
to your personality and situation.
Keep your head high. A new chapter is to be written. | t**********d 发帖数: 257 | 2 Very nicely put. I want to add something to the last point. It is meaningful
to appeal, because it will tell your chair ``you cannot let me down without
a fight'', assuming the chair indeed was unfair to you. | e***h 发帖数: 137 | 3 Everything that kills you makes you feel alive. Please don't give up for
appealing, their goal is to make your life miserable, you shouldn't let them
sleep that well either. | s********t 发帖数: 4150 | 4 Emotionally, I support this statement. In reality, it is not so much more
than a vent-out.
Unless you have a WMD and you are ready to wage a legal war, it is
impossible for a single person to defeat an army of administrators and
lawyers. Remember, the department chair and the dean represent the
university administration, which the president and so on are ready to defend
, and they have the resources to do so.

point is not to give up when there is still an established way of fighting
back. Just like "at will" employment in the industry, there is not much one
can do against the system, but at least we've done everything we can
possibly do. Then move on, life is more than this. | s**********i 发帖数: 468 | 6 why not go through a law suit if all your "hardware" are better than
previous tenured people in you department? | s********t 发帖数: 4150 | 7 There is no such thing as "hardware" in a tenure case, bro.
The substantive judgments can be wrong in the candidate's perspective, but
it constitutes no basis for lawsuit, as long as there is no severe
discrimination or procedural errors.

上去好,可是容易被恶人无耻的人利用。有些规矩,我倒是觉得中国的还好些。
