时间紧只能连夜赶路，那天大雨，好不容易雨停了，11:30pm左右就离定好的Motel只有
14Miles的地方（在Ohio接近West Virginia的地方）在高速公路上撞了一只鹿，还好免费升级
了一辆Hundai Tucson SUV。人都没事，车右前方受损。因为以前在MIT BBS 看过一些帖
子关于使用MasterCard Rental Insurance建议不要买Rental Company的LDW. CNN的一个
采访节目里也有一次关于Rental Insurance也建议不用买。在租车前我还专门打电话问了
Citi Platium MasterCard确保他们是保"Lost of Usage" 。经过三个多月的折腾，终于
把所有Mastercard Claim要的文件都交齐了，上个月终于收到Budget的Bill，要$6800，
其中修车大约$4000,"diminution of value"要$2000, 其他拖车费，Administration Fee

我车最近也撞了，正在和progressive搞呢。
首先你是否肯定你没有责任？一般如果对方和你证词一样的话，责任判定很快的。另外
有没有证人也有帮助。
其次谁的责任对你来说，无非就是付不付deductible的问题。如果对方保险公司负责，
那么你就不用付了。但是根据你的描述，看上去你没有在自己的保险公司报案。这种情
况下你有风险。如果到时候鉴定出你有责任，而你超过了自己保险公司报案的时效，你
可能要自己掏腰包。所以建议你还是去备个案——当然被自己保险公司知道你出过事故
，哪怕不是你责任，也有一定可能要涨保险费。
定损：
不知道你是什么州。去查一下你的州的fair claim法律。通常来说，保险公司不能指定
你修车的机构以及不能规定部件的品牌。但是他们通常都会push你到他们的修车店去做
estimate。你拿到了900刀的estimate，一般保险公司就根据这个给你支票。但是你可
以选择不接受。因为保险公司的bodyshop一般都会用非oem的部件，或者隐藏一些问题

来哪里有CDW。最好问租车公司和仔细阅读fine print。
出了事故你自己的汽车保险公司付修车费，信用卡公司付deductible。但是你自己还可
能要付几种费用，比如：
administrative fees
"loss of use" fee - 租的车在修车期间不能使用了
租车损失严重的话可能付汽车的10% diminution of value - 撞过的车以后出售要掉价
以上费用你自己的汽车保险公司和信用卡公司一般是不会付的。
撞倒别人不想走自己的保险可以考虑买租车公司的 liability coverage。经常租车还
可以考虑买整年的non-owner liability policy。
对这件事人们有不同看法。省钱当然是只用自己的保险和信用卡保险。但不少人遇到上
述费用，所以最好先问清租车公司再做决定。 |

position, semi-cartoonish looks and one of the most comical manual shifters
on the market (honestly, it’s like a bowling pin), this is still a
ridiculously fun car to drive. Forward thrust is short of a Mini Cooper S

发帖数: 350 | 44 事情经过是这样。我去年刚买的新的车被人撞了，对方全责。对方的保险公司Geico花
钱把车子修好了。但是因为此次事故我的车的估价比市场价减少了3000刀。（我手上有
CarMax的trade in appraiser和KBB trade in value，相差$3600刀还有一家dealer给
我出的证明说明我的车因为这个事故只能Trade in 13K,如果没有这个事故他们会给价
16K）。我原本想着拿着dealer出的估价证明跟Geico谈一下，希望对方赔偿一部份的
diminution value。但是对方一口咬定说只负责把车修好，不愿意赔偿任何
depreciation value。今天咨询了律师，律师的意见是sue Geico胜算很大，因为是新
车，尽管修好了车的贬值也是显而易见的，建议和他们合作。而我需要承担诉讼费大概
150刀，请专业Appraiser验车费，按小时计价，如果开庭当天需要appraiser出庭的话
，要支付对方出庭费，按小时计价。赢得官司后，律师需要我最终获赔款的1/3作为提
成。我现在决定和Geico死磕这个case。但是有点纠结是否和律师合作。
