The notice of fililng for the Application for Permanent Employment
Certification submitted by the employer contains a wage, $XX,000-$YY,000 per

新Perm刚交，但是律师就是不给交的日期和收据。但在我Review申请表（ETA 9089）的
时候， 上面有ETA Case Number。
1）如何根据这个Case Number查这个Case的状态 （如合适提交的，有否批准等）？
2）何时开始要Link这个老的Priority Date。

1、律师说可以降级；AILA说USCIS接受基于旧的EB2 Labor Certification的新的EB3
I140申请。
2、雇主（HR）已答应给钱；雇主不给PP费用。
3、PP可以自己出；如果PP被拒，钱会退回申请人；没有PP审批大概3-5个月。
4、EB2的I140仍然有效，如果EB2又比EB3快，可以用EB2的I140。（不知道是否需要再
提交485及另外交费）
5、（如果新排期不倒退，）由于EB3已经Current，因此可以双飞485。雇主支付485费
用。

certified PERM application not being included with the filing. This is a
part of the requirements for submitting a premium processing request for an
I-140 filing. In order for USCIS to accept the request, they must have the

我一起递交了I-140和PP. PP rejected by the end of 15 days, then the online
status changed from ‘Acceptance’ to nothing but the message below:
'On April 2, 2014 we mailed the document to the address we have on file. You
should receive the new document within 30 days. If you do not, or if you

job 2,3,4总计 5年5个月。
ETA-9089上要求的工作经验是几个月，现在俺不清楚，看拒信律师是不是写了84个月？

case number and in the email:
"this is a confirmation email that the ETA form 9089 - application for
permanent employment certification for company name sponsoring my name for
the postion of xxx (case number A-10xxx-xxxxx)..."
Actually I did not know the meaning of case number until yesterday I found
it online. I found that not only the year was wrong, but also the date.

PD按我google的理解是指140批了以后，你SUBMIT PERM(ETA FORM 9089)那个日子。注
意必须是140批了，所以我不太清楚你EB3 PERM批了，但是不交EB3 140,继续搞eb2
perm 140,是否还能relink EB3 PERM.
另外PERM过程是指：
1. Prevailing Wage Determination (1.5 to 2 months)

一般, EB3: Level I, EB2, Level II，也可能EB3 level III, IV,取决于你的job

早上HR来找 以为是挂了 结果是Certifying Officer先发了信

was already submitted, the USCIS service center was unable to process that
quickly. We received a letter from the USCIS on how to rectify this issue
and are working on ways to re-file. We will touch base with the Dept. of
Labor to get a copy of your ETA 9089 forwarded as needed.

最近转公司 绿卡pending快一年半了 各种原因目测没希望在走人前拿到绿卡了 专心研
究AC21 基本新公司会请求Labor Certification或者至少PERM case number ；拿到了
PERM case number到这个网站 http://dolstats.com/ 是可以直接查到Labor Certification的
那么首先你可以
1) 和现公司交涉 如果公司人好就会至少提供PERM case number给你
2) 当年在提交PERM的时候 律师会发一张ETA9089给你签字 一般会贼兮兮的只给你要签
字的那张 如果当时有自己copy一份的话 左下角有一个ETA Number，那就是PERM case
number
但屡次和现公司lawyer交涉，对方任何关于我perm的信息都不给：petition、ETA9089
、case number、job description...统统一口回绝统统不行！我当年没有那张需签字

这里贴一下，希望对近期准备自己办理H1B的朋友们有所帮助。
首先是拿到Offer Letter,并与公司说明费用（加急还是不加急）。以后的步骤是：
1．填写Online 的Foreign Labor Certification form (Form ETA 9035E),
从http://www.lca.doleta.gov/ 点击Apply进入即可。第二步中有Online Wage Inquiry,
可自动查得你所在地区所从事职业的薪资标准。全部填完后提交，只要你的工资水平不低
于标准工资水平，提交完数十秒钟后会自动生成certified 了的 ETA 9035E。这时你需要
将其存盘并打印出来，并请你的主管签好字证明所填无误即可。

一大早，H开着他的SUV来接我，10点来钟，我们装完车正式出发。H车上的GPS显示，从
湾区到死谷460多迈，ETA七个半小时。5号高速公路两旁樱花盛开，有白色，浅粉和桃
红，衬着碧绿的草坪，显得格外妖娆。一路上光影变换，景色迷人。我们在途经
Tehachapi时，眼看着乌云沿着山峰越积越厚。开到峰顶时下起了冰雹，气温也只有30
来度。开过山头，出了乌云区，一下就阳光明媚起来。回头看看乌云笼罩下渐远的山峰
，不禁想起“翻云覆雨”这个词来，想想它引申出来的含义，觉得还挺形象的，自己偷
偷乐了一会儿。
下午三点来钟，我们已经到了190，ETA也只剩下了一个多小时。因为我们没有事先买水
，而在死谷hiking又需要大量水分的补充，我们停在了190上看到的第一个加油站，H负
责加油，我去打听哪里有walmart或safeway。进了加油站的小店，店员很热心的告诉我
从我们所在的加油站到死谷的路上可谓是一无所有了，只有返回10多迈，顺着178可以

不过这些拉美国家总的说来都不是很靠谱，这么重要的policy居然没个正式通告，只能
在中文微博上找到一些贴子。按上面的说法，阿根廷9.2号即日起有美签证的就可以用
ETA不用去使馆办签证了，但直到现在使馆网页上也没有相关信息，我9月6日去LA阿根
廷使馆问过，回复是As of today chinese citizens still need a visa to enter
Argentina.类似的，按中文微博，Chile7月1日开始有us visa就可以免签了，Peru说是
9.21开始。但Peru，Chile的使馆网站上到现在也没有相关信息。
另外前面有个给出置顶FAQ－Q1， 我刚去查了，Peru，Chile，Argentina都明确写着
visa required. 只有Argentina在visa issuance下面提到了 Schengen Member State
or USA (B2), must apply for ETA，注意1是写了B2，2是没说可以免签，姑且认为是

我是觉得光西雅图温哥华加周边十天都不够。

大概是因为不需要异地还车可以省钱。
另外Calgary也办过冬奥哦。所以路线上，
飞Calgary为基地，去Banff Yoho Jasper Waterton再回来。
