从485交上去快7个月今天终于收到卡了首先要感谢bigbigbee,等绿卡的日子郁闷的时候
他就安慰我说, pat pat,7月底肯定批, mark my word.还真是神算啊.同时也给我很多
信息和建议.真心祝福他也greened soon too.
7 months,经历了心急如焚,心神不安.过去几个月每天醒来第一件事就是查状态,睡觉前
想的最后一件事就是:”什么时候给我批呀”. 每天必做的事情就是上mitbbs, 看别人
报绿, “cong and baozi”(我现在几百个包子基本都是这么赚来的).所有的暑假旅行
计划随着焦虑的等待眼看都要泡汤.我一直后悔递了2个485,花钱买罪受,otherwise my
eb1 485 should have been approved in TSC a few months back. but who knows,
right?
Lg的Eb2 140早在几年前就批了,485排期一直没到.我的Eb1花了2个月准备了材料.基本
我就是发了十几个email找推荐人.没有很快回复的我也没有 follow up,回复的快的我
很快把draft发过去签名.最后准备了6封信,尽量做到多样化,现在的manager,中国一个,
美国一个,韩国一个,英国一个,西班牙一个,推荐信基本用的律师给的模版,其他材料就
直接把当年phd毕业找academic job的东西拿来用.1月初140+485递上去的时候因为看到
版上说PP容易招RFE,没敢PP. 没想到lg的Eb2排期今年1月突然就到了,想也没想就又递
了一个485.两个485 RD只差3天,但是我的eb1 485 在TSC,他的Eb2 485在NSC. 我当时还
想着一边一个,哪个快就给我先批很好,其实后来证明根本不是这样.
因为有他的485做backup,我就斗胆PP了我的eb1 140,10天后倒是顺利的批了.我高兴得
以为过两个月就可以拿到卡了,因为看到好多光速的案例from tsc.没想到这一等就是半
年多.
首先是lg的两个485有两个不同的alien numbers. we got EAD and AP pretty soon,
around end of February, and then we got FP notice for our Eb1 485. .跑去打
了指纹. When we arrive home, I found the status of our eb1 485 shows
transferred to local uscis for additional processing, which makes me really
nervous. I did some search online, many people said it means interview.i
tried to guess reason for the interview, but I can’t find any possible
reason. One week later, the status show our case got transferred to NSC
again!
过了半个月,又收到eb2 FP notice,我们跑去FP center问怎么办.那个officer在我们的
FP notice上写了一段话,说明不用再打FP,我们跟他说想用EB1 那个485,因为eb2 排期
随时可能倒退,又不知道要等几年.他让我们给NSC写信,告诉他们我们要consolidate
two 485, and use the Eb1 140, also mail them copy of the FP notice he has
put notes on. We did what he asked us to do, and no news after that. two
month later I went to local uscis center for infopass to check whether they
have got our mail. 碰到个很不耐烦的人,态度很不好,说你们的两个485已经
consolidate拉 and in process,what do you want? 我无话可说,只好回来继续等,决
定再也不去做infopass. I then sent an email to NSC followup email address
hoping I can get more information there. It turns out that they did provide
more useful information than the infopass. I roughly send email to them once
per month.
End of March they told me :” Our records indicate both of your files are
located at the Nebraska Service Center. It appears the cases are currently
waiting for assignment to an officer for final review. If you have not
received a decision or other notice of action on these cases within 60 days
from the date of this message, please contact us for updates.”
End of April they told me:” the case is assigned to an officer. Although
assigned, we cannot predict the date the case may actually receive review.If
the applicant has not received a decision or other notice of action on this
case within 45-60 days, please contact us for updates.”
End of May the same response.
in June I started getting very impatient, I called uscis trying to do SR,
but they told me because my case was originally submitted to TSC, I need to
follow the processing time of TSC, and can’t do SR yet.后来我发现first tier
的接线员基本没有任何用处,they can only see the same information “case
status” as we see online.后来我他们每次一接我电话,我就直接request transfer
to next level of customer service. Sometime they asked why, I told them my
case has some complicated issues. 他们一听就给我转了.转到next level以后SR也
可以做了,而且他们可以提供更多信息.
同时我开始联系议员,6月底他们帮我去问了.答复还是waiting for final review,
please wait for 45 days.所以他们说只能等45天再说.事实证明找议员是最有效的.将
近30天的时候就批了.在这30天内我也没闲着,继续我的电话,email骚扰.而且基本每天
一次.有一次email回复说:” I have copied the officer to whom your file has
been assigned to let them know you have inquired about your application and
with the thought that if there is any status information they can provide
they will let me know and I will in turn provide it to you. Officers can
have as many as 1-2 hundred files in their custody at one time so it is
possible the officer simply has not had an opportunity to review your file
yet.
Beyond that I am unable to predict when the officer will make a decision on
your application or when or if you will receive your Permanent Resident card
. You are welcome to inquire whenever you wish and if you have not received
your document, a decision or other notice of action within 60 days of the
date of this response then feel free to contact us again after that period
of time has elapsed. “
我继续骚扰,抱怨说3个月前就告诉我final review了,已经等了90天了,怎么还没
decision.到底卡哪儿了.他们没有说卡哪里了,所以我也不知道是真的IO没时间还是
background check, name check之类的,但是议员说他们没提这些,应该没这些问题.我
继续发email, 他们显然也有些烦了我.后来告诉我:” We are not obligated to
respond to you more frequently than every 30 days. I last responded to you
on 7/3/12 and you re-inquired only 9 days later. Please be aware we monitor
all of the inquiries we receive. If you contact us sooner than 30 days
from the date of this response we will delete it without reply. I copied the
officer with my last response as I indicated. They did not get back to me,
however it is entirely at their discretion whether they choose to do so.
While I understand your concern, because I am not in a position to direct
the activities of or otherwise supervise adjudicating officers, there is
little else that I can do for you beyond what I have already. “
既然他们都这么说了,我就不敢再发email了.想想再这么下去我恐怕要郁闷死了.lg说
要不我们出去玩吧,你就可以不想这破事了. hiking了几天回来觉得好累也很开心.睡得
很香.可过了几天我又开始烦躁.开始每天一个电话骚扰. Until 7/24, the person
told me again it is pending, call back in 30 days. I called again 7/25, a
nice person picked up my call. I asked if he can get additional information
from the database. He went to check and told me:”looks like there was some
movement in your case, you should get decision soon. But I can’t see what
movement it is”. 我听了很高兴.终于有动静了.but still no update on my case,
called again 7/26,碰到个态度很差的人,感觉就想直接挂我电话的样子. “I can’t
provide any other information to you other than the status. Your case is
still pending, is there anything I can do for you? “我开始觉得昨天那个好人
是不是安慰我了. 又开始郁闷,觉得这么等下去我真的要抑郁了.还好晚上状态就变成
card production.又过了5天,收到卡了.
我没有有些人那么好的运气,但是我也很知足了.总的教训就是
1. 如果eb1的140批了,就不要递eb2了,it will cause unnecessary delay.
submitting two 485 won’t speed up the process in my experience
2. You need to be completely on top of it, don’t rely on the attorney,
what they can do is just make phone calls, and you can do more than that
yourself.
3. Senator is the most useful method, phone call and infopass not much
help, you may get some useful information only if some nice customer
representative pick up your call, otherwise you will be even more 郁闷.
4. Sending emails to check status is useful sometimes too, as they can
send inquiry email to the IO who is processing your case directly sometimes.
Although most of the time you just get 模板回复. | p**p
