the USCIS has a bit more discretionary power to deny or approve EB-1A cases
even if the applicant demonstrates 3 types of evidence in the First Tier.
The totality of evidence must establish that the alien has:
Sustained national or international acclaim in which the alien¡&#
175;s accomplishments have been recognized in the field of expertise.
Note that this acclaim must be maintained until the present date of
filing. An alien who has achieved extraordinary ability in the past but has
failed to maintain a comparable level of achievement will not satisfy this
part.
Level of expertise indicating that the alien is among the small
percentage who have risen to the very top of the field of endeavor.
