Bought a house through a Trustee's Sale in California (i.e. non-judicial
Foreclosure Sale). After the auction, found there's someone still living in
the house. This person is not a renter (no contract, never paid money),
nor is she the previous owner (the previous owner died several years ago,
though she claims to be the daughter of the previous owner). So we want to
do the eviction process to gain possession of the property. So that means
after giving that person the regular notices, we need

Not serious advice by any means, but it sounds like if this
is your property then she is trespassing. You can either sue
her directly or point a gun at her and force her to leave,
hehe.

eviction order 只能通过ud100拿吧。。。
建议不提forecloser, lease可以是oral的。。。
serve notice(寄,希望tenant不读)效期后, 立刻file default order, 通常
tenant不会answer court。 sheriff 不会理tenant/foreclosure的, 只是执行
eviction order。

Thanks for the all the advice. After doing some more research, CA laws are
quite complicated, and many cities have their own Rent Control laws which
protect the tenants. So we decided to hire a professional eviction company
that's experienced with foreclosure evictions. Hope all will go well.

Call 911 first and see what they can do.
Usually if whoever live in your property cannot show any document to prove
that he/she has any current/previous legal bind with your property, he/she
must leave immediately. It's simply trepassing. This is different from
tenant/landlord issue. Don't be stupid. She is not your tenant by all means.
She is illegally occupying your property.
Again, call 911 first and see what they can do. Even if they cannot force
her out immediately, at least they will tell

It's your property and she has no rental contract.
It's a trespassing and as KennyD said, you can even put her
at gunpoint.

it's more complicated than what you guys think. it's a trustee's sale.
it's not like she moved into your house. she can claim she has an
verbal rental agreement with the previous owner.
I'm just surprised why they are foreclosing it after the owner died for
3 years. Isn't the property/liability goes into probation after the
person dies?

A current resident in a foreclosed house is not a trespasser and you cannot
solve the problem by calling 911.
You need to do the legal eviction, but with a slightly different procedure.
It can be very time consuming.
If I were you, I would try to "cash for key". Ask if she wants to move out
for $2000, otherwise, you will evict her. In most cases, she would be happy
to take the money and gone.
