卖家还说要到银行拿short sale extension.(本来最后一天是10月29号)。卖家那边说要延长到11月8号。 但是卖家说要short sale approval过期以后才可以拿到extension.
请问如果我不同意 extension,我这个时候walk away.是谁的责任？我会有什么损失？

文章中说seller可以任何时候stop the business at any time.
现在不是seller想终止，是我想终止我想walk away。我不在乎appraisal, and home
inspection。但是我的钱down pay, closing fee 等都在escrow。我想问除了
appraisal, and home inspection.我还有其他的钱会被扣么？

发帖数: 3244 | 6 you should work with your agent and the listing agent on this. rent back for
two weeks is not smth big and should be able to work it out. if you refuse
to close the transaction without any legal excuse, you are in default and
will lost your EM. even if you have legitimate excuse not to close it by 10/
29, the seller's bank may pull the plug if there no extension of closing
being filed and as a result the transaction falls apart. if so, your escrow
will need the seller's signature to release your funds and if the seller
delays to sign the release form for over 30 days, the money will go to local
county and you will need legal process to get them back. yes you can sue
the seller, but I don't think any court will help you much since the seller
is in hardship already plus hadn't done anything wrong base on what you said
here. even if the court decide that the seller should pay for your lose,
what can you get from someone already doing a short sale? They got nothing
to lose. So be careful. Talk to your agent for this.

很多银行，如BOA, WELLS FARGO等等，shortsale用的addendum上面都明写着卖家不能
租回来住的，如果卖家拿了政府的三千刀，HAFA里面也要卖家搬走。rent back在很多
情形下是有欺诈银行的嫌疑。你签过这些addendum没有？拿出来看看，然后给title
company写封信，应该能把钱拿回来。不行就找律师。
偶也看中过shortsale的房子，卖家也是这副德行，拖拖拉拉的不想搬，我们就cancel
掉了。

还找我的代理呢，问题就出在我的代理。我发现对方卖家的代理是老美两姐妹被告过说
是broker mislead,misconduct. 其中姐妹中的一个被revoked broker license. 可是
我搜到的新闻报道说是他们还继续行骗。我还搜集到sell agent 的website suspended, 公司地址两个，不是空房子就是假地址。在合同上应该写两个seller borker firm 本该是公司名字，可是居然只是那个代理的名字而不是他们网上的公司名字。seller agent那一栏写的是代理的名字。
我自己的代理其实是知道一些这里面的猫腻的
。可是她上周压着我１０月２１号签ｅｓｃｒｏｗ最后的文件。然后说这是解决的办法
，让seller rent back.其实她是想压这我鉴字，然后她好拿钱。房子成了我的他们继
续住，这里面的纠葛她肯定就不管了。
这里面的事情让我想退出。

找一个房产律师咨询一下？
每个城市，每个银行的shortsale条款都不一样，每个case拒绝签字之后的后果也不一
样。看你在这里问一下，问一下，时间都溜走了，我都替你着急。 |

发帖数: 590 | 15 short sale很多grey area. 我也是看到对方的代理急着拿钱走人，卖家又不想搬，才
觉得情况不对，escrow之前就cancel了。
找靠得住的律师把，我觉得你损失的可能性不大，good luck!
