看中的房子是一个建筑材料公司今年夏天买下的foreclosure,翻新后重新上市的,其
间没有人住过。卖方口头说虽然是foreclosure,但房屋情况保持得很好,他们没有大
的改动,只做了翻新和升级,会给我们一个修缮的价目表。本来一切顺利,直到问他们
要disclosure information.他们只给了一页申明(节选如下),大意说由于他们没从
前房主那拿到disclosure,他们自己也没住过,所以不知道disclosure information.
然后说买家有权利在合同生效前或inspection contingency期间自行检测,但除合同中
的问题他们概不负责。顿时觉得很诡异。。。有人遇到/听说过这种情况么?
2. The subject property was acquired either through a trade for other real
property or at foreclosure and/or has been held solely as an investment
therefore, the Seller has no knowledge or very limited knowledge of any
items that might otherwise ordinarily be disclosed, due to the fact that: a.
None of the seller’s employees, officers, directors, or shareholders have
ever occupied the property as a residence or business. and / or b. Seller
has not received a property disclosure from the former owner(s) and / or has
only owned the property for a short period of time.
3. Buyer has the right to inspect, test, survey, study and perform any due
diligence necessary with respect to the property prior to executing any
contract and/ or during the inspection period as specified in the Purchase
and Sale Agreement, if any. Additionally, buyer shall be given the
opportunity to purchase title insurance at closing.
4. Seller hereby discloses and Buyer acknowledges that one or more employees
,officers and/or owners / shareholders of corporate seller hold Georgia Real
Estate License(s).
5. Seller does not guarantee or warranty the condition of the property other
than as agreed in the Purchase and Sales Contract....

这个很正常吧,他们买的时候是sold as is的,建筑公司在这方面没有选择检测也是正
常啊,自己请个inspector做个inspection就行了啊。
另外,我们州的法律是这么规定的,如果前任房主没有检测,那么新房主可以选择检测
或者不检测,但是如果新任房主自己做了检测,查出了什么不好的毛病,在再次卖房的
时候,必须对购买者说明,否则是违法滴。
所以,这下你能理解建筑公司的做法了吧,他们从前任房主那里没有拿到检测,所以,
他们手里没有历史检测资料,他们自己本来买这个房子不是住的,是用来翻修卖的,就
更不可能,没事儿做个检测,万一查出个好歹的,这不是自己砸自己的生意么~~
