HARTFORD, Conn. -- A federal judge in Connecticut has ruled that part of a
federal law that defines marriage as between a man and a woman and denies
federal benefits to married gay couples is unconstitutional.
U.S. District Judge Vanessa L. Bryant in Hartford ruled Tuesday that the
provision in the 1996 Defense of Marriage Act violates the Fifth Amendment
right to equal protection.
The ruling came in the case of six married same-sex couples and a widower
who sued after being denied federal benefits. The plaintiffs are from
Connecticut, New Hampshire and Vermont.
Advocates for gay and lesbians applauded the ruling but expected an appeal.
Several similar rulings have been made by courts across the country. The
Obama administration has asked the U.S. Supreme Court to settle legal fights
over the law. |

I really should study more about these gay-related legal matters which sound
so very much complex.
By the way, I am curious what caused the judge's stance on these issues to
evolve over years. I assume they were not originally pro-gay in today's
manner.
Should Republicans be fumed with these recent defections of some high-
ranking GOP-appointed judges? |

US district court是聯邦法院的審議庭，每個州至少一個，
有些州大點兒，可以分東西南北中幾個區。
然後可上訴至us court of appeals, 上訴庭有12個大區，
也稱作12 circuits。

circuits的由來，是建國初期法官不夠用，所以各地巡迴。
要說建國初當法官可真不是好差事，又費腦又奔波。
巡迴法院之後就是上訴最高法院。
目前第一巡迴法院審理的幾個麻州案包括Gill v.OPM ，
已經送往最高法院等待審理。
上次在微博上看到我關注的幾個國內的法學人士，
談及最高法院就同性婚姻的討論有望在大選前出結果，
幾個人認為這事兒最高法院通過的可能性不大，
甚至把大法官的宗教背景都揪出來談，
也不知道是國內的法學人士不了解情況，
還是並不真的具備法制獨立的素養。

早期的是由最高法院的两名大法官骑着马或者坐着马车，
晃当晃当晃当，去巡回法庭跟当地法官一起审案子，
三个巡回庭来回转。
最高法院的法官实在就是苦差。
John Jay是美国第一任最高法院的chief justice，
干了几年累得吐血，辞职回纽约州当了州长，
亚当斯接班第二任总统，给John Jay写信邀请他回最高法院，
John Jay说，哥们儿，干不了了，大法官这活儿忒辛苦了！
