有经验的同学麻烦出点注意～～～看看我这种情况能在contest hearing中说服法官么？
---“黄灯变红灯的同时，车前轮刚好压线，处于待右转状态，整个过程没停车，继续右
拐”。当时是前方是黄灯，所以继续开车准备右拐，灯突然变红时，车头都出线了，前车
轮刚压线，当时如果停车觉得车会因为惯性停在路中间（可能挡住行人或横行的车辆），所以没
停车继续右转了。。不过整个过程车速很慢。。
借此也提醒大家，貌似对于红灯右转罚款，如果像我这样申请contest hearing有被记
点的危险。。。 |

但是你要contest hearing了，就等于承认了driver是你，

发帖数: 4765 | 20 这个我来回答一下。今天早上我就去的contested hearing，不过输了，呵呵。庭上和
法官一张张看我上周末照的十三张照片，研究情况花了十几分钟。最后法官犹豫后还是
判了Redmond赢。
如果是criminal case，应该就是赢的。没关系，出来依然灌水。
一般说来，警察有51%的话语权，所以基本上都是必输无疑。但重新选择我还会选
contested。狗熊的人生不是精彩的人生，也不是我的风格。
我觉得你的情况不容易的原因如下：
黄灯下要有judgement，如果危险应该停车。一般黄灯都设计你看到后有足够时间停，
并且后轮过线。所以红灯前轮踩线有两种可能：
１. 开太快，停不下来。就是说你超速了。
２. 正常速度。就是说你刚刚承认了他们告你的。
一般说，和法庭argue你没做是徒劳的。所有完胜的案子都是找其它的理由。不然就是
能少罚点就少点。
如果能你defer（我能，但没有选），可以defer。或者当庭看了警察的报告，或者录像
后觉得没胜算，可以再改。少交点钱出来。

能否继续采用方案B- 求情为主，比如说“经过这次庭审知道自己错了，但是才来美国
不久，正在努力学习这边的方方面面，一直也是守法的老实人。。。希望能从轻，不要
记点。。”。有可能有效么？？？不了解这边的法官，是否能因为求情被打动，会有所
变通？

如果你没听说过defer，那肯定是qualify的了。交$150，一年内不再犯就没事了，但再
犯就全交。
你现在说contested，到法庭后看了警察报告后觉得不安全，可以临时改成mitigation.
至于如果选了mitigation什么理由已经不重要了。什么理由都一样，都能用。

，本来就不记录的。
真正的contested hearing是如果你事先没有要求寄过的话，有city的公诉人给你警察
记录，你当庭看。如果输了交全额，还有记录。但有记录不一定就涨保险。这是个误区。
Qualify是说你七年内没有要求defer过。

就是Setup Speed Trap的话，微调是必须的。

i just tried to give u a little help if possible, as a friend
i could even claim that plz trust my way more than any suggestion u might
come across...coz I have done a lot of research on that
many ppl posted their pseudo-experience while they dont have the real
experience to appear in the court
Like in your case, your argument with the police to see whose words r more
believable will end up in vain and do u no good
You need to choose the right point to start; otherwise your fate is doomed.
Hopefully the police report has something u could start with. u could also

Based on 51-49 rule, if the police felt he found it was your car that was
speeding, then his words would be enough to convict you in a civil court. |

I remember I checked laws and regulations b4 and researched real cases ppl
posted.
As long as the radar is adjusted within a 7 to 10 day period, the readings
from radar is considered valid!
Also, even some1 was caught by the cops by "pace" method, which is very
subjective. That guy will lose the case if he just insisted that the cop is
wrong, because the cop would have written that he has received the pacing
training within a year. And always the judge will take the statement from
the cops because it's the cops!
Ppl develop a lot of strategies toward cops in the court, and so are the
cops...

，好多年来这是标准的做法，也是律师最常用的办法。
一般说来，如果是警察抓你的现行，只要他说你做了，基本上法官就认为你就是做了。
这和刑事案非常不一样。
无论怎样，千万千万别只说“我没做”。那样苍白无力，怎么上去怎么交钱下来。
对付警察证词也不容易。因为警察对付过的司机总比你对付过的警察多。他们会把报告
写得简洁而且滴水不漏的。

say, law is a game...it doesn't matter what the truth is. only the winner of
the game counts...
think about Simpson's case...do u believe in person he is not guilty?

judge basically won't listen to you. He would watch the video with you and
say yellow light means caution, so sorry. He did reduce the fine to $75.
