contract销毁:) Contract remedy最通常的是expectation damages。就是说如果你们有
个contract而对方breach了，他给你们的补偿应该尽量让你们恢复到如果contract没有被
breached的situation---what you have been
expecting.其实你们这种情况不容易计算expectation damages,应该在contract里加一条
liquidated damage clause,这样他们一违约你们就知道自己可以拿多少钱回来了:)当然
了，你们也有责任mitigate
damage，不能说要求在没住进去的这一个月里住五星级宾馆:)
我还没学到具体的程序，也还没有自己买过房子，所以你说还没有close我就assume你和
他们之间还没有sign contract。不过很多agreements都是contracts。你们这个算不算我
不知道。去Yellowbook里找找吧，然后去Martindal |

1. Argue that there is no breach of contract. you have tried to the best of
your ability (long distance relationship is beyond your ability, as would
be the case with any reasonable person).
2. Argue that even if there is a breach, there would be no remedy. Court
will not force specific performance when personal service is involved.
There can be no monetary damage either because the department will have a
hard time proving any damage to the reputation/status |

there is a breach of contract. And sometimes, the statuteoflimitation runs
from the "breaching" time which arguable can be the time they reject
performing the duties.
BTW, if there is no concern about time or money, I do think it will be a
valuable thing to fight for urself on this point. "Right" means asking for
your justice, which is right. |

trading law的，SEC对于insider trading其实是对法律中breach fiduciary duty or
other relationship of trust的一种延伸。具体说来，只要你知道给你信息的人是希
望你保守这个秘密（不管是明说还是隐含），而且这个秘密是一个reasonable
investor会make profit on it(non-public material)，你就为个人利益breach了这个
relationship of trust，就是违法的
这个案例里，Capital One是给他们两信息方，肯定要他们签订了保密条款（就算没有
，也可以assume employee有义务保守秘密），然后reasonable investor会认为这个
data是可以trade的，那么他们就是insider trading |

Western Farm Press 上发表的文章《Bt corn reduces serious birth defects》；
2006年10月11日在《中国青年报》发表的《啄木鸟为什么不头疼？》大段抄袭美国加州

发帖数: 39120 | 46 美国联邦助理检察官1日表示，涉嫌从事间谍活动的联邦太空总署(NASA)前华裔合约雇员姜波，将就违反NASA电脑使用规定的一项轻罪认罪。有媒体称姜波将在认罪后的48小时内离境，而且他已经买好回中国的机票。
姜波今年3月20日被控向联邦干员作出虚假声明的重罪。彭博通讯社报道，他上月30日在维珍尼亚州纽波特纽斯被控违反NASA电脑使用规定的轻罪。法庭文件指，姜波在他的NASA手提电脑中非法下载受版权保护的电影和色情片。认罪协议聆讯定于2日举行。
WAVY网站的报道称，姜波将对这项把政府财产作个人用途的轻罪认罪。报道还说，姜波需要在48小时内离境，但未知时间从何时算起。不过报道称，他们获悉姜波已经购买离开美国的机票。
此外，联邦助理检察官克罗姆伯格1日在向法庭提交认罪协议文件时表示，除了这个轻罪指控外，政府已解决了指姜波作出虚假声明的案件。如果向联邦干员撒谎的罪名成立，姜波最高可判监5年及罚款25万。
姜波今年3月被捕时，联邦当局应NASA的请求对他展开串谋违反武器出口控制法的刑事调查。检察官在4月2日的法庭文件中表示，他们正致力鑑定，姜波是否已将或打算将机密资料带回中国，但搜查没有发现类似证... 阅读全帖 |

和突厥语族对应起来.其实如果不从语言上联系而只依照史书上的
记载,我们史书上说的突厥人跟现在的TURKS根本就是两个不对应的
概念,我们北魏隋唐史书上的突厥最初形成时,是个以阿史那氏为领导
(最狭义的突厥就是他们,但他们早就给灭了),以漠北丁零-铁勒为
主体的游牧民族群体,人种以蒙古种为主,语言文化也主要
是丁零-铁勒的语言文化(受些塞人的影响是可能的).而回纥则是铁
勒一支.回纥人风俗上也有搞狼崇拜,葬礼时以刀割面,"血泪俱下"什么的.
在后来的扩张及西迁的过程中又不断有其他游牧民族被突厥化.
后来出现在阿拉伯,波斯世界里的TURKS主要是大量的已被突厥
化的原塞人(这里广义指从中亚向西的草原上原各印欧语的游牧民族),
因此人种上以高加索人为主. 土耳其人也是属於后来被同化的TURKS
血统上他们多少杆子才打得着最初的突厥人谁也不知道.然而泛突的
基地在土耳其,所以他们的理论有一大部分都是要证明:突厥语和突厥文
化很早就在西方产生了,由游牧的吐火罗人(TURKIC)和塞卡人(TURKIC)带
