摘要
学习和借鉴美国法律和法律文化，对中国现代化建设是非常重要的。但是，扭曲的翻译
，可能会带来事倍功半的结果。前述“国务卿”、“白宫”、“总统”一类的翻译词汇
，给人的感觉是：民主国家的领导人同帝王一样，有宫殿，有“爱卿”，可以“总而统
之”。这不利于中国人对民主法治的理解，会在无形中阻碍民主法制建设。为了防止翻
译中的文化扭曲，必须用民主、法治的心态翻译来自美国的法律词汇，不能以专制独裁
的心态对待这些法律词汇。
美国有没有“总统”，这难道也是一个问题吗？是的，这的确是个问题。在美国的政治
法律词汇中，其实并没有“总统”这一概念。中国人之所以说美国有“总统”，其实是
误译造成的。类似的误译还有“白宫”、“国务卿”、“州”，等等。
