US PHD, postdoc, now working at a large biotech company. 申请了4条,
-Published materials written by others (>150 citation and work being
extensively discussed by high level review articles)
-Publications. (9 articles, 2 first author, 7 in English)
-Original contribution (9 reference letters, 1 international)
-Reviewer. (6 reviews)
(有个小travel award 和 a few membership, 怕惹麻烦petition letter没敢提)
IO 的答复很具体,按新guideline来分俩步走.
Part I, criteria evaluation. 不承认published material by others, citation不
算. 似乎没看到 work being discussed by review articles的部分. 承认后三条.
Part II, overall merit evaluation. 说The beneficiary has met at least two
criteria and established the beneficiary meets the minimum eligibility
requirement for this classification. 但是没有足够证据说明the beneficiary is
recognized internationally. 又逐条说承认的三条, 每一条都够了criteria, 但不够
说明 outstanding.
另外还要job offer letter 和 ability to pay. Can not believe 公司律师竟然没交
job offer letter. 这个好说, 交上就是了. ability to pay说提供了evidence
pertaining to its parent company’s finance. 但是 failed to submit any
evidence which establishes its ability to pay the proffered wage.这个具体该
是个什么东西才能证明呢.
公司律师是个大忽悠, 总说strong case没问题. 都NOID了, 还说没问题.不过是在扣新
guideline. 重新组织一下材料再要两推荐信就行了. 可他也说新guideline后他就还没
做过案子. 实在不敢再信他. 拜托大家给出出主意怎样对付吧. 多谢啦. | l******2

单独 文章引用 本来就不是用来证明这个的。 “extensively discussed by high
level review articles” 倒是可以，但看样子，你没有这方面的证明。
你要回复这方面，很简单，就2条：找找看你的文章等有没有 “extensively
discussed by high level review articles”； 还有 有没有 媒体报道。
看来是你的律师瞎搞，自己都不清楚怎么证明，乱claim. 这可不是要两封推荐信就能
证明的。
"ability to pay" , 以前有ID提到过 要公司的税表啥的。

I actually provided evidence for "my works being extensively discussed by
high level review articles" for the "published material by others / media
report", but it seems the IO did not see it at all.
I am thinking since he didn't acknowledge this criteria and has said I met
the other three, I will use this evidence to strengthen contribution and
authorship?
My biggest trouble is how to demonstrate the overall internationally

citation 来证明，我的材料里列举了引用来自的国家。
Anyway, 我8/25 eb1b pp 刚刚递出去，和你背景大概类似，也很紧张。

not only need to mention new evidences, but also lists out the existing
evidences that IO might missed.

你虽然提了。但估计是你的组织结构比较乱，IO 不愿意去翻来翻去找。
把你的材料再重新整理一下，用简洁明了的结构，别搞太多小分项。比如你要claim 3
条，就列3条，然后一条一条去用材料去证明。

也是scholar, review, contribution过了，total不够international，给了一个NOID。
我还有一个已经开始生产的patent,结果这个io完全无视。给我的noid里面提都没提这
一条。
下个星期就30天了，又偏偏又是长周末，郁闷中。

In the spirit of better late than never,写下我NOID后的经历供后来的同学们参考
8/2011 受到NOID
10/2011, I-140 approval
11/2011, I-485 filing
8/2012, card received
具体操作如下：
PartI，criteria evaluation, 首先感谢他承认我claimed 4 条中的 3 条（把这3条做
实）。没有纠结他不承认published material by others, citation不算这一点，3条
足够了
PartII, overall merit,针对他说我"没有足够证据说明the beneficiary is
recognized internationally，承认的三条, 每一条都够了criteria, 但不够说明
outstanding"，我逐条进行了驳斥和加强.
Publications.又找原推荐人之一的一位editor说明他们杂志多了不起，我的工作多好
，多大影响力啥地，其实原推荐信里都有，车轱辘话再说一遍
Reviewer. 又找原推荐人之一的一位editor说明他们杂志多了不起，作他们editor多不
容易，车轱辘话再说一遍
Original contribution，这条说的最多，又加了两推荐信，一新人一旧人，欧洲的，
律师用了“respecfully disagree”，把推荐信里有关国际影响的段落都引出来。我又
做了个油灯图（感谢本版一下），还加上了从上次到这次准备材料的4个月里，引用国
家从十几蹦到了二十几，包括India这样不是Scientific advanced的国家，足以证明
wide spread international recognization
Overall 的感觉是只要针对移民官的问题逐个有理有据的回答，他也就satisfied了。
再次重申，公司的律师不能指望，这次又是我一个人从头忙到尾，他draft的回稿没把
我气个跟头，打电话把他骂了一通。他脾气倒是好，说understand you are very
frustrated, we all want the petition to be the best it could be,, so does he
... ;-)

从你这个案例可以很明显看出claim多项根本就没有任何问题，即使RFE中不承认，也可
以不理他，直接奔向partII。
