right to use it. or vice versa. i.e. even you're using your neighbor's
land, he/she does have the right to come over to say paint his exterior
walls, work on "his" drainage, which would probably involve some digging.
your situation isn't uncommon. our house sits on a zero-lot-line. one side
of my yard (my land) was "given" to my neighbor on the right. the side
yard from my neighbor on the left was given to me. both of which created
easements. in essence, the lot was shifted. i "loose" some usage of the
land on the right, but "gain" some on the left.
just need to be careful dealing w/ the neighbor. he/she can dig but must
restore to original condition when done.

your original report to find out.
