If your tenant is a good person, why cant he give you 30 days of notice
before moving like a normal reasonable tenant?
If it is his emergent situation cant meet the 30 days of notice, if he is a
good person, why he still expects his deposit back due to his failure to

supposed to keep their responsibility, why do you charge the rent, why do

You ARE ignorant about basic legal concept in the US( Maybe that is why the
landlord said your parents didnt teach you well, I guess. But many people
coming from china do have very weak sense of law). It is illegal to live in
an apartment without the permission of the property owner. It is
understandable that landlord is huge upset and emotional. I would too. I
would say, who the heck r u, why you are in my house, get out.

因为要回国,所以不得不提前中止lease,按照合同,由我负责找下家来take over我的
lease
我到处贴广告,带人看房子,最后顺利找到某人p愿意take over我的apartment
于是landlord按照程序对p进行了credit history check之后,他们顺利签了lease
谁知就在签完2天后,p突然家中发生变故,要离开美国,所以他要求landlord cancel
他们签的那个合同
landlord说,他应该来问我,如果我同意继续负责到找到下家,否则就由我来付剩余那
些month的rent
只有我答应这些,他才能cancel那个lease
我很想帮p一下既然他在困难之中,但是我觉得这对我不fair,我的理解是这个事情从
理论上已经跟我没有关系了,为啥还
把所有的责任都推给我。
无限的烦恼中。。。。

so many high-rise all like this.
Smart for owner.
They dont have to hold liable for hefty heating cost.
If you watch news on TV about those so-called terrible landlords dont
provide enough heat, you only hear one side of the story. Most those old
buildings are rent-controlled, landlords are not allowed to raise rent to
market level and forced to cover heat and water, which make landlord lose
money by renting and even can not refuse to renew lease on those old tenants.

Hi 各位前辈,
想请假一个棘手的问题。我和朋友hold了一个公寓,我们交了2100刀的money order作
为订金,但是交钱时我们没有签合同和其他任何具有法律效力的文件。只是那个
landlord给我开了一个receipt。
这是一个经营apartment的公司,一直打交道的是一个挺威严的leasing manager。但是
我们临时有变动,没法住这个房子了,想stop payment。因为目前距离我们sign
contract的时间还有一个月,不知道现在cancel了合不合适。大家通常是怎么处理这种
情况的呢?
现在我们的money order是pending。我问了银行,银行说我只要拿着自己的customer
copy of money order就可以stop这个payment,然后两个工作日后,钱就会打回到账户
中。而且我们stop,对方不会即时看到,除非他们想要出这笔钱或专门去查。
现在好像钱这方面到时能拿回来,但是landlord那边我不太确定该怎么处理,我们通过
自己这边撤销,钱是能拿回来,但landlord那边有我们的护照复印件和申请信息。他们

My HOA requires landlord insurance, and the property damage coverage is at
least 50w. My insurance company is statefarm, the landlord insurance premium
is cheaper thn home owner insurance. But the latter one qualifies multi-
line credit, the landlord doesn't.

上星期楼下搬来了一家斯里兰卡人,有小孩,一天到晚又蹦又跳连喊带叫.第一次找他
们complain,未果.刚才第二次去的时候那家的女人说什么你们没孩子就得忍着.
我们这里是二层的公寓,landlord是一家realty company.每层都是one bedroom的那

我们在IL, 刚刚查了州法:

问题就是我们的HOUSE是MOVE IN CONDITION.也就是买买家具,洗洗地毯,刷一下地下室
而已.我们的LANDLORD就更不用说了,她说她愿意以现在我们的租金租给我们找到的房客
,但是我们要给她1000块,赔偿她可能能租到更好的价钱.另外这个房客要一个月后才能
搬进来,所以我们其实只省了1200. 但是LANDLORD还省了付给中介公司的佣金,因为是我

When I moved out of my apt., the landlord charged me $180 for some damage to
the apt.which I even did not understand (the damage decription). Since we
got most of the deposit back, we accepted the penality. Later we met a
lawyer who was willing to try to get the money back for us without charge.
He just sent a letter to the landlord demanding detailed info about the
damage. The landlord returned the money right away.

I now live in OHIO. When I was hunting for a house to rent, my landlord told
me that the community is very safe. However, within the first week after I
moved in, somebody tried to break in the house. I called 911 and also
informed my landlord of this thing. Later around the same scary things
happened several times. I would like to terminate the leasing contract
because I thought the landlord lied/misled me on the housing information.

You need to read your lease contract carefully.
Usually the contract should state that how many days advance that you need
to send written notification to landlord to renew the lease. Please notice
that to renew the lease means you have to sign another half year lease.
Even if the landlord agrees to renew with you, you will be responsible for
paying half year rent.
Your case is kind of special. You just need to ask your landlord to do you
a favor for additional one month lease, which the rent

我们看中了一个condo,现在要签lease了。lease上说"if the landlord wants to
sell the unit, landlord shall have the right to end this lease by giving 30

in the notice"。这是不是说房东可以随时中止lease而不需要任何理由?那签一年的
lease还有什么意义呢?

住了5年的公寓,搬出来后说我们除了deposit外还欠2500刀的清洁费。后来几次电话,
还有
certified mail联系landlord,都没有成功,certified mail还没拒收了。对方态度就
是反正
我说你欠你就欠的样子,最近这个accountant被卖给讨债公司,我们写了cease letter
去,告诉他
们我们首先没有任何agreement,第二执法部门也没有ruling说我们欠钱。让讨债公司
闭嘴。
这个landlord是无礼加无脑。他给我们的receipt里有两张还是他们自己家另外一个投
资公司开的
repair receipt,我们上secretary of state网上一查,投资公司法人就是landlord
本人,
他们自己给自己写receipt,况且这个公司是投资公司,怎么能开出repair receipt。
我平时就是做
审计的,这个都可以告警察局说fraud了。
本来我们懒得要900多的deposit了,但是现在人家缠着不放,还要另让我们叫2500刀。
我们只好搜集
材料准备去small claim court。要搭时间和精力。

合约就是合约, 不愿意接受开始的时候就不要签.
以前在学校租学校的宿舍就是类似的霸王条款.
不过一般这样的lease都可以允许sublet或者从landlord那里拿一个可以sublet的许可,
自己需要提前解约的时候sublet.
这种问题, 一般可以跟landlord协商解决, 提前一个月通知他, 大部分landlord都通情
达理, 或者在local找一个move in续上你的约.

看就签了。最近房东不时抽查我的垃圾,在kithen waste 里面发现一小块可回收的塑
料板,把它挑出来,然后就给我了一个25块的罚单。我argue 了一下,现在收到了

看到版上有人提到无良中介不退押金还多charge钱,想到自己的合同也马上到期了,先
问几个问题,做好准备。我租房的中介网上差评很多,几千块押金一分不退的时有发生。
我在这个房子里住了一年,是prviate suite,四间独立bedroom带bathroom,客厅和厨
房公用。合同是单独签的。去年搬进来的时候非常急,看房当天就搬进来,看房的时候
看到bedroom有点积灰,地上有些死虫子,带我参观的人说屋子还没有professional
cleaned。但是我打算搬进来以后,立马改口说已经clean过的。当时拍了几张照片,给
他们看,他们不看。照片还保存着。厨房和客厅搬来的时候就很脏,因为住着一个老印
,一个伊拉克大妈。当时中介说我不用负责公用部分的卫生,但是其实只是口头说,后
来发现lease里明确写着中介清理公用部分我们四个房客都要分摊费用。
一年里面中介打扫过一次公用部分,粉刷过一次公用部分的墙,过来修过几次公用的洗
衣机(我搬来之前就坏了,当时隐瞒了这点,一直修了3个月,在我们的坚持下终于给
换了个新的),修过一次暖气。

My company only requires a $500 deposit, but I know some do take more and
only for the purpose of "locking you in" so you can't change your mind
after you get good advice on a site like this! Good for you that you walked
away. NEVER put anything down more than a token $300 - $500 "good faith"

多少钱跟保多少有关,没买过renter insurance. Landlord policy 是home insurance
的一种,比owner occupied的要贵一些,应该不是伞险。我找的是insurance agent,
她替我办的。

Should be OK. If you are concerned of your health, you can write to your
landlord to request to move out.
Before you find a new place to live you can require to live in a reasonable
hotel on your landlord's expenses. Of course you still pay rent during this
period if he covers your hotel cost.
This hotel expense should be covered by your landlord's insurance.
I know the rules but have never done this.

我当时住的地方楼下的美国本科生每天晚上放摇滚乐放到半夜亮点。
我去找他们谈过,过两天还是一样, 在他们门上贴过纸条,请他们安静,人家根本不
理。
找landlord , landlord 也不管。
我们当时恨不得自己搬走。 可是landlord 又不让违约。 。。

The rent is depending on how many people will be living there. We currently
have 6 people, and it is 1350 per month. If you have less people living in,
it might be less(you need to call and ask the landlord).

仔细研读了下MA GOV的文件也问了几个美国朋友,他们给的建议比较狠毒。。
仅仅给landlord一份书面证明,不用管landlord怎么说,也不用交十月的房租。十月底
的时候直接上飞机走人,走之前留下钥匙。这样做比较不道德,但是landlord在法律上
没有任何办法。因为法律规定房租晚交15天才算late payment,那时候即使房东赶我走
也需要一个14 days notice。这样我最终需要搬走的日期就是10 29,那时候我已经在
国内了。
这样做我不会有任何经济上的损失,但是应该会留下不好的记录。房东如果要告我的话

Damage Deduction for Security Deposits:
The landlord must return your security deposit or balance within 30 days
after the termination of tenancy. The landlord can only deduct for the
following:
◗ Any unpaid rent which has not been withheld validly or deducted in

If you have cleaned to reasonable standard, say landlord can just rent
without doing extra cleaning, they should not charge you.
Reasonable. You should throw stuff out.
Go check 1. There is no need for you to do deep cleaning on carpet as long
as it is cleaned.
this is landlord responsibility. Exception, you break their smoke detector
they installed. Yet it only costs about 10 bucks each.
YOu can argue with landlord and keep all contact evidence. Take photos if

lease里有这么一段话:
If resident wants to vacate the apartment home on the Lease End Date and
terminate the Lease without further liability to Landlord for Rent, Resident
must give written notice to Landlord at least 90 days before the lease end
date of resident's intent to vacate the apartment home.
If resident has not timely given the termination notice to landlord, then
resident shall be a month-to-month tenant from the scheduled lease end date
on the terms and conditions in the lease.

The manager is right. You need to think from other people's shoes and take
care of your own responsibility described in the contract to sublease. You
can surrender only if your landlord agree to give you such "favor". The
landlord has no obligation to "help" you, especially when you are not in
good terms with the landlord.
