为什么叫做 Public Charity 呢？因为它们是 serving public interest or common
good。
下面这段话你没读好，可能你没兴趣吧。仔细看下 Reference 17 就比较清楚了。实际
的意思是501(c)(3)下面有两种，一种是 public charity，另一种是 private

希望能够效率更高， 当然也就要尊重出钱的人意愿。
但是米蒂现在贫富差距太大， charity补充政府功能这点被有钱人的意愿过于左右了。
譬如charity给一些疑难杂症， 这不是当前社会主要矛盾， 这些疑难杂症就算攻克了
， 也只有有钱人能治的起。 其次就是为了其社会和政治利益服务， 甚至起到一定的
继承免税功能。
就看美国现在政府财政问题这么严重， 有钱人还有心思去折腾鲨鱼和非洲野生动物呢。
所以不考虑宗教那口， 其实我觉得大部分宗教的charity还是对社会共享更大一些，比
那些liberal的无聊charity。 这个口子也确实应该拿过来给政府了， charity的效率
优势不在， holes却已经太多了。 |

老乔是很痛恨charity的， 不知道为什么。 这个人性格也确实有点扭曲。 做事情走的
非常极端。 连自家的几个房子都transfer to trust, 真是一毛都不留给遗产。
信托是可以免掉estate的税务， 自身的正常运作都是要缴齐各种税务的。
慈善org的日常运行有很多免税项目， 但是为了自家的名声, 还是要做很多事情， 这
些额外的开销有时候可能比税务还要高。 适合子女数量少比较小资的， 做一些拯救非
洲野生动物之类能够抚慰他们的soul的工作作为消遣。 而且charity fund的具体执行
business还是很受限制的。 很多还需要再整一个壳去从事正常的工商业活动。 所以大
家族大规模的fund很多只是trust or foundation, 并不是慈善， 或者分一小部分去慈
善那里避税。 譬如洛克菲勒家的。
美国的犹太人也是做了很多类似的fund. 譬如我在neighborhood看到的一些信托的广告

等等）。我一听到这说法就觉得不可信，这年头网上传言太多，人必需用点脑袋。
为何我第一反应就是不相信？因为基于我对 charity 的一点了解，6% 这数字太离谱
了！你说 20%，30%，这我还可以接受，但一个几千万规模的克林顿基金会胆敢做到只
有 6%？！我不信。
事实上美国社会对 charity 的监督极为严格，原因很简单：美国很多人捐钱。为了保
护自己的钱，大家都比较谨慎，希望得到更多资讯，所以 charity watchdog 这行业也
就应运而生。主楼已经举出几个，还有更多。在这么多人监视下，一个大型基金会敢做
到只有 6%？太大胆了。
不止民间的 Watchdog, IRS 也在严加看管。不要搞错，不要以为 nonprofit 真的就
100% 免税，不是这样的！nonprofit 有好多种，他们某些收入在某些条件下，还是要
缴税的。如果克林顿基金会把薪资营运支出报得很高（因而降低了税额），高到不符合

lz父亲来给lz看孩子，结果去了一次ER，后住院手术了。父亲已经回国了。因为没有买
保险，所以回国后，父亲送来一些证明，办了charity care，免去了住院费用。但是还
有别的单子不能免（大概4，5个医生啊，化验啊之类的单子，加起来5，6千）。当时lz

目前Chase正同过Facebook举办一次慈善机构的Voting competition.排名前一百的
charity会得到$25,000的奖金.
The Hometown Education Foundation (HEF) 是Wisconsin大学杨同海教授发起的,主要
贫穷山区中小学生的一个慈善机构.(Detailed info can be found at http://www.hometowneducation.org/).在成立几年来,HEF已经帮助了数百的贫穷孩子.
这次的competition还有30个小时结束(截止时间为星期二中午).HEF目前排在第70位,但
只领先第100名大约90票,所以并不能保证HEF最终就能排在前100名.
能否最终排在前100名而得到$25,000的奖金对那些需要帮助的山区贫苦孩子来说是是很
重要的.$25,000可以帮助到上百的贫穷中小学生.

receives a substantial part of its income, directly
or indirectly, from the general public or from the
government.”。这样的 public charity 要符合 IRS
509(a)(1) 到 509(a)(4) 的定义。

（1） public charity 究竟对公众有多少披露信息，回答质疑的义务。
另外怎么查某个 charity （比如 ACCEF）是 public charity
还是 private foundation。
（2）如果一个人，上 internet bbs 网上为自己募捐，但是没有用到任何
public charity，收钱的帐号都是自己的帐号。这个又归哪些法律管？
（3）同（2），但是用了 private foundation 向公众募捐，这种

这还是快金字招牌，买买提，华人，摇篮网上都是一个账号，早就被人认出来是OSCCF
的。goodlaok(神气活现的老K)也有参与。各大华人慈善机构代言人依次亮相给康妈站
